South African surrogacy has changed significantly since 1 April 2010.  This has imopsed significant changes for all parties concerned and surrogates are required to ensure that they carefully understand every thing.

 

A top South African lawyer has instrumental in taking the lead in submitting surrogacy agreements to the High Court.  This initiative ensured that commissioning parents in a surrogacy contract have parental rights and responsibiliities and surrogates relinquish this responsibility. 

 

Prior to  this process, a process of adoption was required which was lengthy and risky for all parties involved in the surrogacy agreement. 

 

An established and timeous process is underway whereby the surrogate attorneys request all necessary documentation.  This is made up of the proof of identity, psychological assessments for commissioning parents and surrogates as well as medical reports for both parties.  Upon the contract being compiled and ratified by both parties, the surrogacy agreement is submitted to the High Court. 

 

Actual embryo transfer into surrogates may only proceed upon the high court approval.  This serves to protect both parties and there can be no dispartity at any later stage.
